What the R&D tax relief advance assurance pilot means for SMEs

HMRC has introduced a new R&D tax relief advance assurance pilot to help SMEs gain earlier certainty on complex aspects of their claims.

Launched 18 May 2026, the 12-month pilot reflects the increasing pressure on businesses to ensure R&D claims are accurate, compliant and well-supported.

For SMEs investing in innovation, it offers an additional opportunity to gain clarity earlier in the claims process and approach submissions with greater confidence.

How does the R&D advance assurance pilot work?

The pilot allows SMEs to seek HMRC’s view on specific aspects of their R&D tax relief claim before submitting it.

Unlike the existing full advance assurance scheme, this is a targeted service. Businesses can make up to two applications for assurance, but each application is limited to one project and one area of R&D relief.

It’s also important to note that the service is:

  • Voluntary.
  • Available to SMEs only.
  • Structured to provide responses within 40 days (where sufficient information is provided).

What can HMRC provide assurance on?

Under the pilot, SMEs can request HMRC’s view on key areas that are often subject to challenge, including:

  • Whether a project qualifies as R&D for tax purposes.
  • Whether overseas expenditure is eligible.
  • Whether contracted-out R&D can be claimed.
  • Whether the PAYE/NIC cap exemption applies.

Businesses can make up to two applications in total, so focus on the highest-risk areas where early clarification would be most valuable.

2. Prepare a robust application

HMRC’s response will depend on the quality of information provided. Clear technical narratives and supporting evidence are essential.

3. Consider timing carefully

Early engagement can provide greater certainty, but it may also bring forward HMRC scrutiny.

4. Remember this is not a substitute for a claim

Businesses must still submit a full R&D claim via their Corporation Tax return and complete all required documentation.

Businesses should also check the main eligibility conditions before applying. The service is only available where:

  • The business is an SME that has not yet claimed R&D tax relief for the relevant period.
  • Assurance is being sought on no more than two areas.
  • Full claim advance assurance has not been requested for the same period.
  • Neither the company nor a connected person has entered a DOTAS arrangement, been categorised as a Corporate Serious Defaulter, or is subject to an open Corporation Tax enquiry

How does this differ from full advance assurance?

The existing full advance assurance scheme remains available, but a company cannot apply for both services for the same period. The pilot is best suited to SMEs seeking clarity on specific issues rather than reassurance across an entire claim.
